Queensland Small Business Owner Pathway
This stream is for migrants who are currently living and operating a small business in a regional area of Queensland.
Applicable regions
4124 to 4125, 4133, 4183 to 4184, 4207 to 4275, 4280 to 4287, 4306 to 4498, 4507, 4517 to 4519, 4550 to 4575, 4580 to 4895.
Applicants must have an occupation that is on Home Affairs Instrument LIN 19/051, and have a positive skills assessment in their nominated occupation. Applicants under this stream must have full-time work rights and not be currently studying.
This visa is a provisional visa that allows nominated skilled workers to work and live in REGIONAL Queensland for five years and is a pathway to permanent residency.
Requirements for Pathway 1 and Pathway 2:

Occupation List: have an occupation on Home Affairs’ relevant list of eligible skilled occupations (LIN 19/051)

Living: Living in regional Queensland

Working: The applicant must be working for the business full-time (minimum of 30 hours per week)

Ownership Interest: Provide evidence that you hold 100% ownership of the business
(Partnerships or joint ventures are not eligible.) -
Location of business: You must own and operate a business in regional Queensland.
Apart from above requirements, applicants must also meet the additional requirements of Pathway 1 or Pathway 2:
Additional Requirements for Pathway 1 and Pathway 2:
Pathway 1 – Purchase an existing business

The business purchased must have been operating for a minimum of 2 years in its current location, immediately prior to purchase.

Purchased a business for a minimum of $100,000.

Your business must have been operating the business for a minimum of 6 months after settlement.

employ of at least one Australian resident working a minimum of 20 hours per week, OR 2 employees working 10 hours per week.
Pathway 2 – Start-up business

Have started and operated a profitable business in Queensland for at least 2 years immediately prior to submitting an EOI
-
Minimum $200,000 turnover in the last 12 months.
Eligibility criteria
To be eligible for Queensland nomination, you must meet both the Australian Home Affairs criteria and Business and Skilled Migration Queensland (BSMQ) criteria for your chosen visa category.
The Home Affairs criteria require Applicant to have the following

Have a Point Score of 65 or higher, inclusive of state nomination points

Have a Positive Skills Assessment in your nominated occupation

Age under 45 years

Meet the minimum English language requirement of COMPETENT, unless a higher level is required by your assessing authority

submit additional documents if invited to lodge an application for a subclass 491 visa.
Small Business criteria require Applicant to have the following

No vendor financing
-
No share transfer (must have a contract of business sale)

Cannot purchase business from family member
-
Cannot relocate, sell business or, purchase a business previously owned by a 491-SBO applicant

Commission agents or leasing agents of franchises (such as petrol stations), and home-based businesses (including those with virtual offices) will not be considered

Applicants must operate their business for at least 3 years in a regional area (and may be subject to monitoring) after the grant of the visa.
