Streamlined PR Pathway for Hong Kong Residents

5 Years of Temporary Graduate Visa

Current and future students from Hong Kong will be eligible for a 5-year temporary graduate visa once they successfully complete eligible tertiary studies.

  • Those former students already on a temporary graduate visa will be given an extension of up to 5 years, starting from 9 July 2020

  • These graduates will also have a pathway to permanent residency after 5 years

    • For those who study at a regional campus and choose to live and work in regional Australia, the pathway to permanent residency will be available after 3 years.

Pathway to Permanent Residency
Two new pathways to permanent residence for eligible Hong Kong and BNO passport holders will open for applications on

5 March 2022, through 2 new visa streams:

Subclass 191 – the Hong Kong (regional) stream

This stream is for primary visa holders who were usually residents in Australia for a continuous period of at least 3 years immediately before applying and who lived, worked and studied exclusively in a designated regional area for that period, while holding the qualifying visa.

Subclass 189 – the Hong Kong stream

This stream is for primary visa holders who were usually residents in Australia for a continuous period of at least 4 years immediately before applying, and who held the qualifying visa during that period.

 

  • Eligible Hong Kong passport holders will be able to apply for one of these permanent visas, depending on where they have lived and worked in Australia.   

  • Applicants will need to have substantially complied with the conditions of their qualifying visa (such as meeting the usual health, character and security requirements).

 

Subregulation

Hong Kong and BNO passport holders will need to have

  • held and complied with the conditions of the relevant temporary graduate or temporary skilled visa for at least 3 years for applying subclass 191 and 4 years for applying subclass 189

 

  • The relevant temporary graduate or temporary skilled visa are:

    • Subclass 485 (Temporary Graduate) visa

    • Subclass 457 (Temporary Work (Skilled)) visa

    • Subclass 482 (Temporary Skill Shortage) visa

  • No Point Test 

  • No Income Test

  • No English Test

  • Can bring dependents if aged over 23. 

  • Meet Health and Character requirement.
